A power of attorney is a document by which you appoint a person to act as
your agent. An agent is one who has authorization to act for another
person. The problem with a regular power of attorney is that it ceases to
be effective when you become incapacitated. To overcome this problem, you
need to have a durable power of attorney which "endures" through your
disability and remains valid to protect you when you need it most. A
durable power of attorney can be made for both financial and medical
decisions. In addition, you have the option to determine when the durable
power of attorney takes place - either upon signing of the document or upon
findings by two doctors of your choice stating that you are unable to manage
your affairs.
